TERMS OF SERVICE 2018 (FURSUIT COMMISSIONS / PREMADES)
Auburn.Tale's Fursuit (Commissions / Premade) Terms of Service TOS 2018 (UPDATED)

 

**By purchasing a fursuit or fursuit pieces by me (i.e. heads, tails, hand paws, tails, feet, etc.), you are agreeing to the terms listed within this document. Please note that these terms of service are final and I hold all customers and commissioners to the same standard so that both parties are treated fairly. If there is something, in the terms listed, that you would like to discuss, please message me and inquire! It is entirely up to the customer to make sure that they have read the TOS COMPLETELY before commissioning, purchasing and signing the TOS (Terms of Service). Thank you!**
 

** I work on suits daily! However, I am human and I am inclined to take days off like everyone else! If for some reason I take an extended break, 3 days or more, I will notify everyone via Instagram story, Instagram post (@Auburn.Tale), and through furry amino (@Auburn.Tale)! I would recommend that you follow either of my accounts so that you may receive updates! **
 

 

General Commission Information:

1) YOU MUST be over the age of 18 years to purchase. By purchasing and signing the TOS you are stating that you are over the age of 18! I will NOT sell to minors regardless of parental permission.
 

2) Buyers are responsible for the proper care of their suit and suit pieces! I will not be held accountable for damages to pieces due to negligence and misuse. You can find information on this via google for proper care and cleaning information.
 

3) Suits and suit pieces will wear out over time. This time will vary on how well you take care of your piece, the amount of time it is used / handled, etc. I am not responsible for natural wear and tear. I cannot give an exact amount of time your piece will last as it varies too greatly.
 

4) There is no warranty at this time. This being due to the fact that I am Canadian based and majority of my customers are from the US or International. It would cost too much to ship it back for repairs and then back to you. It would be too costly for either of us to pay such a fee! I am sorry for any inconvenience that this may cause. You can look into getting another more local suit maker to make the repairs at a cost. This may be a cheaper alternative! If you are set on me making the repairs I will gladly do them but you will be responsible for fee's shipping to me and back. You may also be charged repair fee's. Please contact me for more information regarding this.
 

5) Buyers understand that Full suits and Partials may difficult to wear. They can get hot, and have visibility that is less than normal eyesight. We are not responsible for any injuries you may incur while wearing a fursuit or fursuit piece made by us. This includes, but is not limited to heat stroke, dehydration, claustrophobia, falls, etc. Please keep hydrated, take breaks and make sure you have someone present with you to help! 6) ALLERGY ALERT! I do own cats so there will be traces of cat hair or even possible dander on these suits. We do state this repeatedly and will NOT be held responsible for any allergic reactions you may have whether you knew you were allergic or not. I do not let the cats sit on any of the product however they are in the same room so I cannot guarantee there is no cat hair/dander on them.
 

7) You MAY NOT use the fursuits I make for money-gaining purposes (reselling at a higher price, etc.). Though you may own the rights to the character I still OWN THE RIGHTS to my artwork and fursuits are a piece of art! If you intend to sell your fursuit or fursuit parts they can be sold for no more than what you yourself paid for it!
 

8) Since I OWN the rights to my artwork, you may not to reference, or use the fursuit or fursuit pieces in ANY way other than for fursuiting, art collecting, photo's etc. If you are confused by this rule, please contact me IMMEDIATELY.
 

9) Fursuits or fursuit pieces will NOT be shipped out until payment is received in FULL. If you purchased via auction you have 7 days to send your payment. If payment is not received in this time it will be sold the next person or put back up for auction. Commissioners will also have 7 days to send payment. If payment is not received the commission slot will open again for someone else.
 

10) I will gladly send more photo's of the fursuit or fursuit pieces to people who request them if they are interested in a suit that is up for sale or auction. I do not send update or progress photo's for commissions. If you want to see updates for commissions please check my Instagram (@auburn.tale).
 

11) PLEASE make sure to check your notes/comments/DMs frequently. I may ask questions as to make the experience pleasurable for every party involved.
 

12) I have the right to refuse any commission without giving a reason. This, however, rarely happens.
 

13) When and if you decide to commission me, I ask you to contact me and provide me a detailed reference/description of your character. If there is any other information you deem helpful please include it. Please try to have your payment READY as well. It is okay if your payment is not ready at the moment BUT please be aware that I do NOT start any work on your piece till payment is received in FULL.
 

14) Don't rush me, please. I try to work in the order that I receive payment for commissions, and this will vary depending on what I feel like working on THAT DAY. I cannot guarantee a set finish date as suits and suit parts are complex pieces and need time and care put into them to get a high-quality finish. I appreciate your patience above anything else!
 

15) If you are commissioning me, please check my gallery's current works to make sure you like my style. My anatomy may change with the personality of your character.
 

16) I will build any species the commissioner likes but please look at my previous work to be sure my style is what you may like! Please note that this only works if I have a reference sheet! I WILL NOT accept written descriptions. If you do not have a reference sheet please come back when you do!
 

17) I allow changes and adjustments to the pieces in the foam base stage. Once the foam base and fur colors are approved and I begin sewing and furring I WILL NOT be able to change anything. (UNLESS, it is a mistake in the design due to my own fault and not changes by you yourself to the said character.)
 

18) At the current moment I accept PAYPAL and Card payments via Invoicing through Paypal. Please note that I only ship product upon receiving a FULL payment. I do not normally allow payment plans. HOWEVER if you wish to go this route please CONTACT ME and we can discuss it. Most likely there will be a non-refundable deposit and will not ship the product till full payment is processed. PLEASE NOTE. I do have the right to refuse and or deny a payment plan!
 

19) I am not responsible for what happens to pieces in the mail. If a piece is lost, we can discuss ways to repair the situation. A product that is bent or dinged upon arrival is not my liability.
 

20) I am NOT responsible for shipping, customs or any other additional fee's that may pop up when shipped to you! Please make sure you look into any additional fees like customs that you may face. I will NOT pay them nor do I accept refunds on items!
 

21) I DO NOT offer refunds! So please make sure you have the money to afford the suit or pieces and that you like my style of work before you purchase. I do understand emergencies happen. If so, please CONTACT me and we can discuss a partial refund.
 

22) When product is shipped or the commission is completed, I will contact you to let you know. Please do not bombard me with messages asking if it is shipped yet. I understand your excitement but it does put stress on me! I do not offer update photo's. To get updates please check my Instagram (@auburn.tale) as I post daily pictures there.
 

23) We do NOT accept returns OR exchanges. You are free to go online and trade your suit via forums or websites if you wish. I, however, will not take a purchased suit and exchange it for another suit through me!

 

 

What Can You Do With My fursuits and fursuit pieces?

Upon receiving your commission / premade, YOU ARE ALLOWED TO:

1) You may upload images to any of your art galleries of your choosing. I kindly ask that if you do so, to please properly credit me! Do NOT claim that the suit, or art, was made by you yourself.
 

2) You may print out whatever digital work I do for you. You may hang it on your wall, show it off to friends, etc.
 

3) You may sell the commission / premade for THE PRICE YOU PAID FOR IT. If you are selling a character bundle, you must not charge more than what you paid for the work.

 

 

Upon receiving your commission / premade, YOU ARE NOT ALLOWED TO:

1) You are NOT ALLOWED to use the purchased fursuit or fursuit pieces to gain a profit! The commissioned/premade pieces are STRICTLY and ONLY for PERSONAL USE only and are not to be used for commercial or retail purposes.
 

2) You are NOT ALLOWED to claim the work as your own (this is obvious, but needs to be stated).
 

3) You are NOT ALLOWED to deface or destroy the commission / premade in any way, such as drawing on top of it, tearing it apart or 'ruin' it in any way. If I ever find out you defaced my hard work, any further business with you will be terminated.
 

4) You are NOT ALLOWED to pull apart the piece to COPY how I made your piece (i.e. how the base was made, eyes, paw patterns, sewing patterns etc.). You are violating my terms of copyright by copying and or referencing any piece you purchase from me.
 

5) You are NOT ALLOWED to resell my work at a higher price! A commission /premade is a piece of art created for someone personally, and in no way should it be resold. Should you choose to sell, as stated above, you cannot sell the piece cor more than you paid for it!

 

 

Customer Satisfaction: [2018] If there is a problem with the commission, it is YOUR responsibility to tell me at the time of the foam base approval. At that time, I will email / contact you to look and verify the base and fur colors before I begin! Update pictures will be found via Instagram! I WILL NOT be emailing update OR progress pictures. It is YOUR responsibility to let me, as the artist, know everything in advance before you proceed to let me work freely. You will not be refunded for work that you are not satisfied with. We can come to a consensus about where the issue lies, but I provide too many opportunities for changes and cannot afford to refund commissions after they have been completed. (as previously stated in my terms and conditions). Please make sure that you are okay with MY interpretation of your character; our brains are not the same, so clarification is prudent.

 

Discounts & Coupons: [2018] If you are a frequent customer, I am inclined to repay your business with discounts. These discounts could be percentages off or dollar amounts off the final price of a commission. Note that this is given RANDOMLY to customers. Do not beg me for discounts because you purchase work from me. My discounts or coupons are meant to repay you for your kindness. Asking for them does not make me want to repay you. Make sense? I want to reward you for helping me with my dream! :)

Mailing Regarding Customs Fees: [2018] As per the rules stated, once I have mailed the work (aka paid the shipping fee) I AM NO LONGER RESPONSIBLE FOR ANY ADDITIONAL FEES IT MAY TAKE FOR YOU TO GET YOUR WORK. I am not responsible for the customs fees in your country. YOU should be doing the research on this before commissioning me. It is not my responsibility to make sure that you are not paying an additional fee on top of what you have already paid for my work. Please inquire about this BEFORE commissioning me, because I am not at fault if your country charges you additional for the piece is marked as a custom (as will happen with Fursuit merchandise).
